Privacy Policy & Terms of Service

1.1. "Affiliate" means (i) controlling party of; (ii) subsidiary of; or (ii) party in the same control of PT Karawang Outlet Mall.

1.2. "Application" means a web portal which we developed to become an electronic medium to (i) find Information regarding Tenants in The Grand Outlet's Property; (ii) manage Loyalty Points; and/or (iii) other functions needed to support the Malls ecosystem.

1.3. "Personal Information" means information regarding yourself that can be privately identified and collected through the application, such as name, address, date of birth and occupation (if you are a person), corporate data and identity document (if you are not a person), phone number, e-mail address, permit and/or the equivalent, and other information which may identify you as an application user.

1.4. "We" means PT Karawang Outlet Mall, a company established under the laws of the Republic of Indonesia, and/or its Affiliate.

1.5. "Terms of Use" means terms and conditions or standard operational procedures or any other provisions relating to each application developed by the The Grand Outlet's and/or its Affiliates (as applicable), and as may be changed or added from time to time by the The Grand Outlet's and/or its Affiliates;

1.6. "Loyalty Points" means a promotional credits earned by providing us information regarding your transaction within our Tenants.

1.7. "Customer" means a party registered as a customer of the application to use the Service provided in the application.

1.8. "Website" means our website in www.grandoutlets.com or any other website developed by us to support our ecosystem.

2.1. We collect certain specific personal information from you to facilitate the application to perform its function whether for the use of services (if You are a customer) managing service provisions (if you are a service provider), or other functions essential for supporting the Service ecosystem. This Personal Information can be supplied directly by you, such as when you sign up as an application user, or it can be collected automatically as you use the application.

2.2. When you visit the website, a website administrator will process technical data such as your internet protocol address, web pages you have visited, internet browser that you use, web pages you previously/subsequently visited and the duration of every visit/session which enable us to send website functions. In addition, there are situations where your browser may suggest activating your geo-location system to enhance your internet and/or application experience. With this technical data, the website administrators can manage the website, for example by resolving technical difficulties and improving the accessibility of certain parts of the Website. Using this method, we can ensure that you can easily and swiftly always access information on the website.

2.3. Information that you provide directly.

2.4. When registering to the application, you will provide us with specific personal Information pursuant to the terms of use required by each type and function of the application.

2.5. When you use the application to use or manage a service, you provide us information as relevant, such as, if you are a customer, the types of services, location of the information query occurred and/or total amount of transaction cost, or, if you are a Tenant, order data and data related to Loyalty Points management, the amount of fund of the Service transaction and or other data as a support for the Service ecosystem. When you use our Application, we will also process your technical data such as, internet protocol address, internet device identity (ID) or media access control address, and information regarding the manufacturer, model and operating system of the device that You use to access the application.

2.6. In connection with the Loyalty Points facility which may be available in the application, we will collect information relating to such transactions made by you, including but not limited to the number of points transacted through the loyalty point facility.

2.7. Information which we collect when you use the application.

2.9. A cookie is a small data file placed in Your browser on Your internet device. With cookies, the feature of the application and or website that you access can save information or remember your actions and preferences from time to time.

2.10. Most internet browsers support cookies, but you have the option to configure your browser to reject certain types or specific cookies. Additionally, you can delete cookies at any time.

2.11. We use cookies for several purposes. We use it, for example, to remember your safe search preferences, to help you to use the services (if you are a customer) or to manage the services (if you are a Service Provider), and to protect Your data.

3.1. We use your e-mail address, name, phone number, and or account password to verify your ownership over an account in our application, to communicate with you in connection with the use or management of the services and to provide you information regarding the application. We may also use your name, email address and phone number to send messages, general updates of the application, special offers, or promotions. We will also send you an email inviting you to subscribe to our mailing list. You may at any time choose not to accept the information regarding this update.

3.2. We use the customer's geo-location and destination information to (i) find tenants' information available in the customer's surrounding area and (ii) analyse the application's pattern of use to improve the application's performance.

3.3. We use your personal information entirely to analyse the application's pattern of use. You hereby agree that your data will be used by our internal data processing system to ensure the delivery of the best function of the application to you.

4.1. We may employ or cooperate with companies and people as third parties to facilitate or provide support in developing the application and certain services to us and or on our behalf, to, among others (i) provide costumers' assistance; (ii) provide geo-location information; (iii) perform services relating to Website (including but not limited to maintenance, database processing, web analysis and Website feature perfecting services); (iv) assist Us in analysing how the application and services are used as well as their development; or (v) to assist Our professional advisor or external auditor, including legal advisor, financial advisor, and consultants. These third parties have access over your personal information only to perform those tasks for us and or on our behalf and the third parties are contractually bound not to disclose or use the Personal Information for any other purposes.

4.2. We shall not share your personal information with any party other than to the related tenants (if you are a customer) or customer (if you are a tenant) and the third parties without your consent. However, We will disclose your personal information to the extent it is required by law or required to comply with the provisions of the laws and regulations, government institution, or in case of a dispute, or any form of legal proceeding between you and us, or between you and other users in connection with, or relating to the services, or in an emergency condition relating to your health and/or safety.

4.3. Your personal information may be transferred, stored, used, and processed in a jurisdiction other than Indonesia where our servers are located.

4.4. We may eliminate certain parts of Your Personal Information which may identify you (personal information becomes anonymous and disclose the anonymous data to a third party for the purposes of Application development, database management, Service's analysis or improvement. We also may combine your personal information with other information in a way that the information is no longer associated with you, and later disclose the combined information to the third party, for the abovementioned purposes.

4.5. We shall not sell or lease Your Personal Information to a third party.

7.1. This Privacy Policy shall be regulated and interpreted pursuant to the laws of the Republic of Indonesia. Any dispute arising from this Privacy Policy shall be subject to the exclusive jurisdiction of the District Court of South Jakarta.

7.2. This privacy policy is presented in English.

8.1. By using the application, you acknowledge that you have read and understood this Privacy Policy and the Terms of Use and agree and accede to the use, practice, processing, and transfer of Your Personal Information by Us as stated in this Privacy Policy.

8.2. You also represent that You are entitled to share all of the information You have provided to Us and to give Us the power to use and share such information with the Tenant (if You are a Customer) or Customer if You are a Tenant) to support and perform the function of Application.

1.1. PT Karawang Outlet Mall is a company established under the laws of the Republic of Indonesia ("we", "us", or "our").

1.2. The Application is a software application that serves as a means to find information regarding our Tenant and also for loyalty points based on transactions within our Tenant.

1.3. The Application allows you to send an information request regarding our Tenant. The GPS receiver - which should be installed on the mobile device (smartphone) on which you have downloaded the Application - detects your location and sends your location information to the relevant Tenant Information ("Information").

1.4. The Application allows you to earn and redeem Loyalty Points ("Loyalty Points") by sending transaction information based on your transaction in our Tenants. The Camera-which should be installed on the mobile device (smartphone) on which you have downloaded the Application - captures your transaction receipt and sends your transaction information to get Loyalty Point ("earn point"). Besides that, you can instruct the application to exchange your Payment to Tenant with Loyalty Point ("redeem point").

1.5. FOR THE AVOIDANCE OF DOUBT, WE ARE A PROPERTY COMPANY, NOT A TECHNOLOGY COMPANY.

2.1. You represent and warrant that you are an individual legally entitled to enter into a binding agreement under the laws of the Republic of Indonesia, in particular the Terms of Use, to use the Application and that you are at least 17 years old or have ever been married and not under guardianship. Otherwise, we will be entitled by law to cancel any agreement entered into with you. You further represent and warrant that you have the right, authority and capacity to use the Service and to abide by the Terms of Use. If you are registering on behalf of a legal entity, you also represent and warrant that you are authorized to enter into and bind the entity to, these Terms of Use and register for the Information, the Loyalty and the Application.

2.2. We collect and process your personal information, such as your name, e-mail address, and mobile telephone number when you sign up. You must provide accurate and complete information, keep the information up to date and agree to provide us whatever proof of identity we may reasonably ask for. If any of the personal information that you have provided to us changes, for example, if you change your e-mail address, telephone number, or if you wish to cancel your account, please update your details by sending your request to us. We will, to the best of our abilities, effect such changes as requested within fifteen (15) business days of receipt of the notice of the change.

2.3. You can only use the Application once you have signed up with it. Upon successfully signing up, the Application will provide you with a personal account that can be accessed with a password you choose.

2.4. Only you may use your own account and you undertake not to authorize others to use your identity or account. You may not assign or otherwise transfer your account to any other parties. You must keep your account password and any identification we provide you secure and confidential. In the event disclosure is made to your passwords, howsoever, which causes any illegitimate or unauthorised uses of your account or identity, orders generated from the illegitimate or unauthorized uses will still be deemed valid activities, unless you notify us on that matter before the Tenant perform the requested Earn and Redeem Point Process.

2.5. You may only have one Styles account.

2.6. The information provided by the Application must not be construed as an advice or an offer, the decision to use the Loyalty Point is entirely yours.

2.7. You undertake that you will use the Application only for its intended use to obtain Tenant Information and Loyalty Point. You may not abuse or use the Application for fraudulent purposes or to cause any inconvenience to others or to make fake transactions.

2.8. If you are also a Tenant, you may not use your (or other's) customer account to make an order that you will earn point for yourself.

2.9. You may not harm, tweak or modify the Application and/or Website or attempt to harm, tweak or modify it in any way whatsoever. We are not liable if you do not have a compatible device or if you have downloaded the wrong version of the Application to your device. We reserve the right to prohibit you from further using the Application should you use the Application with an incompatible or unauthorized device or for purposes other than those for which the Application is intended to be used. You undertake that you will only use an access point you are authorized to use.

2.10. You are expected to maintain confidentiality and refrain from misusing the information you acquire through the Application. Additionally, you are required to treat Tenants respectfully and avoid participating in any illegal, threatening, or harassing actions when utilising their services.

2.11. You understand and agree that your use of the Application will also be subject to our Privacy Policy which may be amended from time to time. By using the Application, you also give your consent as required under our Privacy Policy.

2.12. By providing us with information, you represent that you have the right to provide us the information for us to use and share with the Tenants.

2.13. We may, in our sole discretion, provide promotions that may be redeemed for benefits related to the use of the Application. You agree that you will only use such promotions for their intended use and will not abuse, duplicate, sell or transfer the promotions in any manner. You also understand that the promotions cannot be exchanged for cash and may expire on a certain date, even before you use them.

2.14. Please inform us if you no longer have control of your account, e.g. your account is somehow hacked or your phone is stolen, so that we can cancel your account accordingly. Please note that you are responsible for the use of your account and may be held liable even if it is abused by another person.

3.1. The download and or use of the Application is free of charge. We may introduce fees for the download and or use of the Application at times. We will inform you accordingly about this for you to decide whether you wish to continue using the Application or not. However, the Internet connection required to use the Service, and any associated charges (e.g. mobile data expenses) incurred by your use of the Service are your exclusive responsibility and made solely at your expense.

3.2. The loyalty point rates that apply for the Loyalty Point can be found on Application. We may modify or update the rate from time to time. We will help the Tenant to calculate the Loyalty Point based on your transaction and inform you of the Loyalty Point on behalf of the Tenant.

3.3. Loyalty Points is your fund that can only be used for deducting the payment of your transaction in Tenants that used Styles Point of Sale (POS).

3.4. The Grand Outlets may, from time to time, add the number of your Loyalty Points in your account as part of its promotion (e.g., referral code). However, this is only an amount that is equal to the money value under the prevailing laws and regulations.

3.5. When you wish to apply Loyalty Points to reduce the payment for your transaction with Tenants, you hereby acknowledge and agree to grant us the full power and authority to credit your Loyalty Point and remit the Loyalty Points on your behalf to pay for the Services provided by the Tenants.

5.1. We employ appropriate and reasonable technical and security measures to keep the Application secure and virus and error-free. However, as effective as this technology is, no security system is impenetrable. We therefore cannot guarantee the security of our database nor can we guarantee that the information you provide will not be intercepted while being transmitted to us.

5.2. The Application may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications including the device used by you or the Service Provider being faulty, not connected, out of range, switched off or not functioning. We are not responsible for any delays, delivery failures, damages or losses resulting from such problems.

6.1. Any claims against us by you will in any event be limited to the aggregate amount of all Loyalty Point actually redeem by and or due from you when using the Service during the event giving rise to such claims. In no event will we and/or our licensors be liable to you or anyone for costs, interest, damages or losses of any type or kind (including personal injury, emotional distress and loss of data, goods, revenue, profits, use or other economic advantage). The company and or its licensors will not be liable for any loss, damage or injury which may be incurred by or caused to you, including but not limited to loss, damage or injury arising out of, or in any way connected with the Service and or Application, including but not limited to the use of or inability to use the Service and or application.

6.2. You expressly waive and release us from any and all liability, claims or damages arising from or in any way related to the Tenants. The company will not be a party to disputes, negotiations of disputes between you and the Tenants. Responsibility for the decisions you make regarding the Information found via the Application rests solely with and on you. You expressly waive and release us from any and all liability, claims, causes of action, or damages arising from your use of the Service, software and/or the Application, or in any way related to the Tenants introduced to you by the Application.

8.1. Subject to your compliance with these Terms of Use, we grant you a limited, non-exclusive, non-transferable, non-assignable, non-sub-licensable, revocable license to download and installed a copy of the Application on a single mobile device that you own or control and to run this copy of the Application solely for your own personal, non-commercial use.

8.2. You may not (i) copy, modify, adapt, translate, create derivative works from, distribute, license, sell, transfer, publicly display, publicly perform, reproduce, transmit, stream, broadcast, decompile, or disassemble any portion of or otherwise exploit the Application, except as expressly permitted under these Terms of Use, (ii) license, sublicense, sell, resell, transfer, assign, distribute or otherwise commercially exploit or make available to any third party the Application and/or the software in any way; (iii) create internet "links" to the Application or "frame" or "mirror" any software on any other server or wireless or internet-based device; (iv) reverse engineer or access our software in order to (a) build a competitive product or service, (b) build a product using similar ideas, features, functions or graphics of the Application, or (c) copy any ideas, features, functions or graphics of the Application, (v) launch an automated program or script, including, but not limited to, web spiders, web crawlers, web robots, web ants, web indexers, bots, viruses or worms, or any program which may make multiple server requests per second, or unduly burdens or hinders the operation and or performance of the Application, (vi) use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine", or in any way reproduce or circumvent the navigational structure or presentation of the Application or its contents; (vii) post, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior consent of the owner of the proprietary rights, (viii) remove any copyright, trademark or other proprietary rights notices contained in the Application. No licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by us or our licensors, except for the licenses and rights expressly granted in these Terms of Use.

8.3. You will (i) not send spam or otherwise duplicative or unsolicited messages in violation of applicable laws; (ii) not send or store infringing, obscene, threatening, libelous, or otherwise unlawful or tortious material, including but not limited to materials harmful to children or violative of third party privacy rights; (iii) not send material containing software viruses, worms, trojan horses or other harmful computer code, files, scripts, agents or programs; (iv) not interfere with or disrupt the integrity or performance of the Application or the data contained therein; (v) not attempt to gain unauthorized access to the Application or its related systems or networks; (vi) not impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity; and (vii) refrain from engaging in any conduct that could possibly damage our reputation or be considered disreputable.

8.4. We reserve the authority to thoroughly investigate and take legal action against any breaches of the terms. We may collaborate with law enforcement agencies in pursuing legal action against users who violate these Terms of Use. It is important to recognize that we are not obligated to actively monitor your access to or utilization of the Website or Application. However, we retain the right to do so to operate the Website and Application, ensure your adherence to these Terms of Use, or comply with relevant laws or orders from a court, administrative agency, or governmental authority.

9.1. The Grand Outlets and Styles, including its name and logo, the Application and the Service, are protected by copyright, trademark, and other rights provided under the laws of the Republic of Indonesia. We (and our licensors, if applicable) exclusively own all rights, title, and interest in and to the Application, including all associated intellectual property rights.

9.2. Without derogating from our rights under any applicable law or these Terms of Use, you are advised that any attempted or actual infringement of this provision will result in the termination of all your rights under these Terms of Use. If you circumvent any of the means taken by us to protect the Service from unauthorized use, you must immediately cease any and all use of the Service, and you undertake to do so.

10.1. You are under no obligation to use the Application and may simply choose to stop using it at any time by cancelling your account and permanently deleting the Application from your device, thus disabling your use of the Application. This Terms of Use is automatically terminated when you permanently delete the Application from the device.

10.2. We reserve the right to immediately suspend, restrict or terminate these Terms of Use and your use of the Application if we have reasonable grounds to suspect that you have breached or violated any provision of these Terms of Use or the prevailing laws and regulations.

11.1. Our waiver or forbearance or failure to claim a breach of any provision of these Terms of Use or to exercise any right provided by these Terms of Use or the applicable law, may not be deemed to constitute a waiver with respect to any subsequent breach of any provision hereof.

11.2. These Terms of Use are drawn up in English and Indonesian language, both of which versions will be binding on you and us. In the event of any inconsistency between the Indonesian language version and the English version, the Indonesian language version will prevail.

11.3. You may not transfer or assign your rights under these Terms of Use, without our prior written approval. We may assign our rights under these Terms of Use to a third party at our sole and absolute discretion.

11.4. If any term under these Terms of Use is held to be illegal, invalid or unenforceable, in whole or in consent to and acceptance or the modifications, variations, and/or changes.

12.1. You hereby acknowledge that we may from time to time include links or references to other websites, products, services, other content or other materials (hereinafter "Third Party Links"), none of which are controlled by us.

12.2. You hereby acknowledge that these Third Party Links are provided for your information only and that we do not make any representations, warranties or guarantees as to the accuracy, completeness, performance, reliability, timeliness, quality or suitability for a particular purpose of these Third Party Links. We do not endorse, approve or support these Third Party Links. You use the Third Party Links at your own risk.

14.1. Through your use of the Application or other Items, you may provide us with some of your personal information. By using the Application or Items, You authorize us to use your information in Indonesia and any other country where we operate.
